The general supervision and control of the Buhler Municipal Cemeteries of the City of Buhler, Kansas, shall be vested in the governing body to make and enforce all rules and regulations pertaining to the custody, control and care of the cemetery and to determine and collect the price to be paid for spaces therein.

The price of cemetery lots and spaces, and the opening and closing costs of said burial spaces shall be fixed from time to time by resolution of the governing body. All fees collected herein shall be paid into the Cemetery Fund of the City of Buhler.

The proprietor of each lot shall have the right to erect any proper stones, monuments and sepulcher structures except that no vaults or mausoleums shall be built entirely or partly above ground, except if they stand not less than six (6) feet from the edge of the lot upon which they are built. The proprietor shall have the right to cultivate shrubbery and plants as approved by the governing body, but no trees growing within the lots or on the border thereof shall be cut down or destroyed without first having obtained the written permission of the governing body. The governing body shall have the right of preventing or removing erections, enclosures or anything they deem detrimental to the general good appearance of the ground, or which would prevent the easy and proper care of the lot. No mound or any grave shall be raised to such a height that it cannot be easily mowed across with a lawnmower. In no case shall the height exceed four (4) inches above the regular ground line. Enclosures, grave guards, and trellises around any burial space or lot are forbidden. Further, grave markers may be flat markers or above ground markers or monuments, and all shall be surrounded by six (6) inches of wash or apron cement at the ground level to facilitate maintenance. The governing body shall have the right from time to time by resolution to set height and width requirements for any above ground grave marker or monument.

A cement, fiberglass, stainless steel or cast iron box or vault are required on the outside of each casket.

The City Clerk shall keep a record of all burial lot certificates issued and all transfers of burial lots. The Clerk shall also keep a record of all receipts and disbursements made in the operation of said cemetery. The City shall also keep and maintain a separate fund to be known as the “Cemetery Fund”. All monies received by taxation or collected in the operation of said cemetery shall be paid into the Cemetery Fund.

That the price of each burial space, regardless of the number of spaces in any given lot, shall be set at $50.00 per space for any spaces unsold at the time of the passage of this ordinance, said price being subject to change by resolution of the governing body.

The Clerk shall make a record of the size of lots as previously designated by the governing body of the City of Buhler and shall sell said lots accordingly.

The governing body shall make and adopt such rules and regulations by resolution, for their own guidance and for the regulation and governing of the city cemeteries as they may deem expedient and which are in conformity with the laws of the State. They shall also have charge of and supervision for the city cemeteries and shall have the power to expand city cemetery funds to maintain, care for, and improve said cemeteries. They shall also have the power to improve the cemeteries by altering or removing curbing, fencing, trees, and shrubbery, or any part thereof.

All lots in the city cemeteries shall be held as burial places for the dead, and for no other purpose, and when sold shall include the costs of perpetual care (perpetual care not meaning extra care and labor).

No interment of any body other than that of a human being shall be permitted in the cemetery.

That as heretofore stated that the governing body shall have the power to establish by resolution from time to time, all costs relating to the sale of lots and the opening and closing of burial spaces within the Buhler Municipal Cemeteries, except that Lots 9, 10, 11, 12, 27, 28, 29 and 30 of Buhler Municipal Cemetery West, as shown on the plat of said cemetery on record in the office of the Register of Deeds of Reno County, Kansas, shall be designated for the burial of war veterans and persons of the armed forces of the United States and their spouses. These burial sites shall be free of charge, and all grave markers shall be uniform. This section shall be known as the Military Reserve Section.
